No photos after 3 months

Sherry, on November 21, 2016 at 1:45 PM Posted in Etiquette and Advice 0 20

I'm here seeking for advice. So it has been 3 months since our wedding date, and we still haven't received any photos, nothing except for the 1 photo he posted on his FB page. What's really makes me feel uncomfortable is that the photographer lied several times about the delivery date, from the end of Friday, to next weekend, I've heard so many different versions from him so far. Of course, none of them is true. I've told him is that if he needs more time to edit, that's fine with me, just let me know, and I just need some photos so that I can show my family members during Thanksgiving. I mean, am I asking too much?? It's so just hard to reach the photographer, he doesn't really respond to emails, he doesn't reply photo calls, he simply just ignores you. Ironically, he has 5-star review everywhere I can find on the internet - the knot, yelp, google, you name it.

Any suggestions? Honestly, I am thinking he probably has lost our photos.

Is there anything in your contract that says when he will give you your photos?

What does your contract say about when you will get them?

I'm fine if he needs more time, but just give me a date that I can trust right? Also, is asking for just some photos as a preview too much?

He put the delivery dates in email. Does that count?

What were the delivery dates? Having it in writing is something, but it's not a legally binding contract.

Hmmm. How many times has he changed the date on you exactly and what were his excuses? Typically we would recommend that the photographer provide in writing a guaranteed time that you would receive photos when booking...but since that time has past there isn't much you can do. We are coming off peak wedding season so perhaps he is running behind. I would ask him what the hold up is and tell him that you need to know exactly when he plans on delivering them.

Our photographer guaranteed us photos within 6 weeks. It was in our contract. However, I think a commitment in email is valid and should be upheld somewhat. 3 months seems to be a long time to be waiting for photos. I would follow up and not take no for an answer/look into what further action you could take.

We were told mid-Oct., end of Oct., mid-Nov.

He has changed at least 3 times. He said he has finished up with our photos and he will mail to us - what a liar. And last time, he said he's been busy so he hired another person to do the editing work, however, he isn't satisified with the work, so he planned to redo them. He said we will definitely receive them before Thanksgiving. No sign of these photos are coming.

I'm confused. He is MAILING your wedding photos? As in on a flash drive or printed? Can you not pick them up from him? No way would I want the most important photos of my life being mailed to me where they could easily get lost.

There was NOTHING stated in the contract about delivery time frame?? Usually even if it's not a specific date, photographers put something like "photos will be delivered within 6-8 weeks (or however long) after event date." Having a date in email isn't super helpful, because if you signed a contract without a specified delivery date, you're out of luck - you're at the whim of the photographer.

Three months is on the long side, but it's not unreasonable - if the photos are coming soon. You've called and emailed... Have you tried contacting via his/her social media page? If you hear nothing after the next time you reach out, I would suggest asking him/her for a set date he/she will get the photos to you by, and if you don't receive them by the date he/she specifies in email (get it in writing), you will file a claim in civil court (your claim is lacking weight, since the contract doesn't have a delivery date; however, if the contract spelled out that you'd be receiving a product (photos), you can emphasize that you will pursue this because, per your contract, you should receive *something* and you'd like a judge to determine what a reasonable time frame is since the photographer's claims have fallen through numerous times. Unfortunately, there's not much you can do without a specific time frame in your contract.

Yea, it's my bad not reading the contract cautiously. The guy was highly recommended by our wedding venue, and he has very good reviews on internet. And he was super nice before and at our wedding. I trusted him a lot. Now I feel being fooled.

He has an address on contract, but that's doens't look like a studio or workplace address - seems to be his home address.

Do you think posting bad reviews would help? I am thinking about posting bad reviews and the tell him I will remove it after receiving our photos.

Hmmm, I don't know if I would use a negative review as a bargaining tool before I had my wedding pictures in hand. However, after you receive them, I think it would be fair to include details about the long wait time in your review.

Thank you! What do you think about contacting our wedding venue for help? They recommended him to me.

If nothing is in the contract, that makes it very hard to have any recourse. I cannot imagine this not being in a professional photographer's contract, or having that evasive behavior. I think you need to send certified mail and send a letter professionally asking for concrete information on the photos. It can take 3 months, I wouldn't feel right about over 30 days which is what I guarantee.
