Music and copyright infringement...

Lauren, on January 21, 2019 at 8:12 PM Posted in Planning 1 5
So I've been trying to look into this but can't find the answer I am looking for.
I will be asking about wedding videos, and by that I mean, videos family/friends take of the wedding. No music dubbed over. Just the music that is played at the wedding itself.

So, can we get sued if I walk down the aisle to a copyrighted song, the wedding is taped, and we post it online? We are also doing a FB Live of the entire ceremony.
So, are we going to get sued for something like this?

I know most brides walk to copyrighted material and I highly doubt any of you pay the licensing fee... so, what's up with this? Haha..

Long story short, yes I believe you could be sued. I am a high school band director so I deal with video sync rights a lot. We cannot post anything we play online without performers and sync rights. Now in your case, you are not profiting and it is purely for your personal entertainment so it is VERY unlikely anyone would pursue that. And I’m not entirely sure you would even be in violation just posting it with background music. Now if you have a live musician performing an arrangement that would be a problem. The music you play is meant for personal consumption only, so sharing online in any capacity is typically considered a violation. But I can’t inagkne you would be pursued unless your video for 100s of thousands of views or you sold them.

I would look this up and in agreement with PP, I’ve seen folks write “I do not own the rights to this music” on posts that contain copyrighted music

I tried to look it up but only came up with posts about wedding videos with the music dubbed over the video. Not just as "background" music. Such as my aisle song playing while I'm walking down the aisle.

Would saying "I do not own the rights to this music" save me? Lol. Honest question...

It should be fine since the music being played is essentially background music and not music actually added to the video. For streaming purposes on Facebook, you should be fine! I have seen tons of streamings like this and there typically isn't an issue. If you're going to put a full video together and post it on YouTube for instance then I would add "I do not own the rights to this music" as an extra precaution just in case! Worst-case scenario if it is an issue later with posting you'll likely receive a message about it before serious action is taken!
