Marriage license - what name to put?

Lauren, on December 20, 2018 at 2:56 PM Posted in Planning 0 7
I know the county clerks office will tell me what to put when we get there, but I am wondering...
Do I put my maiden (current) name or my new name on the license?

I have read multiple people saying different things. I live in Indiana. I know these laws vary by state. Can anyone help me out?

I've heard "maiden name as that is your current legal name"
but also
"New name so you can prove that is your last name when you go legally change it at the Social Security office."

So which is it? Both sides have stated going to SS office and legally changing names went smoothly...so I am confused.

Why do they have different laws in different states for what to put down on your marriage license!? Ugh! Haha.

I had to write my current full name in one spot and the full name I plan on changing it to in another spot on the license. I’m in California.

So, in my state, I put my maiden name on the marriage license. But honestly, every state is different so you really need to check with the county clerk office.

When it comes to changing you name, you use your marriage certificate to prove your new name, not the marriage license (unless this is also different by state and I recommend calling to find out). A marriage license authorizes you to get married whereas the marriage certificate proves you are married and it is also proof of your new last name. My marriage certificate has my new last name with my maiden name in parentheses. To get our certificate, our officiant filled the marriage license with the town clerk and then a couple weeks later I called and ordered the certificate (there is usually a fee). I would recommend ordering multiple couples as you may be doing some name changing via mail and will need to mail certified copies.

Oh wait do you mean when you sign the license at the wedding? I signed my maiden name. But I don’t think it matters. At the bottom of the certified copy it lists what I’m planning on changing my name to which I put when I filled out the license.

Anyway, I'm just gunna confused myself more talking about it haha. I'll just make sure to ask all the right questions when we go apply for our marriage license. Smiley smile plan to do that in March for an April wedding. Smiley laugh

It's a legal document. Sign with your current legal name. Social security will then ask what name your be using. After that point your name will legally change.

When applying for your marriage license I believe you put your current name because you haven't changed your name yet, so that person doesn't exist and can't apply for the license. Does that make sense, but I think the best advice is to ask your county clerk!

You always sign the marriage license (which is what gives you permission to marry) with your current name. In some (but not all) states, you also state what name you plan to use after the marriage. After your marriage, you get a marriage certificate. You can then (if you choose to change your name) get your name changed with Social Security.
