Is this too long of a wait to get my wedding photos back?

It's been about 16 weeks since I got married, and I still don't have my wedding photos back. My dad is very upset (he paid for the photos), as the photographer has technically broken the contract, since the contract outlines the maximum time to get back photos (10 weeks).....what should I do?! I'm very patient and understand but I'm getting tired of not seeing my photos Smiley sad

    And yes I know the rings just showed up as my picture, not sure why....

    Have you contacted the photographer? What did he say? Have you paid in full?

    Yep...she said her hard drive was down for a week, which I get (she told me 2 weeks ago that it would take a week and I would get them back, as she only had a few hours of editing left)...and now she says 1 more week. Smiley sad I'm trying to not being a total witch about it because I'm not like that but I'm frustrated as heck

    I would call and question why you haven't gotten them back and mention that you were suppose to have them back by the ten week mark.

    I get it if her hard drive was down for a week. But waiting 16weeks so far for your photos while the contract says 10 at most , is very concerning to me. Hope you get them soon!

    Has all of your communication been over the phone, or was some by email? Just curious what has been documented.

    Sounds like she waited until week 14 to let you know about the hard drive issue, rather than warn you prior to the 10 week contracted date that there was going to be any kind of delay. This sounds very unprofessional to me.

    I would put a request in writing for the pictures to be delivered by a certain date. I'm hoping one of our lovely lawyers on here can chime in with suggested wording.

    Have you at least gotten a preview? I would demand at least a small number of pictures to ensure she's working on them but 16 weeks is way too long.

    You need to send a demand letter by certified mail. Getting a lawyer to draft and send one for you will probably have the quickest effect. If she doesn't respond to that, or ducks service of the letter, you will need to file a claim in small claims court (depending on the limits in your jurisdiction's small claims court and what you paid). You do not need a lawyer to file in small claims. The clerk at the courthouse should have a small claims packet available that will walk you through it. Hopefully she is just procrastinating and the demand letter gets her off her butt. It should also be clear in the letter that you are asking for specific performance, not a refund at this point. But let the lawyer handle that. If you don't know a lawyer, call your state bar, and explain hat you need and they can help point you in the right direction.

    edit: I missed that your dad paid. If he signed the contract he needs to do all of this. If you signed then you can do it.

    I give you kudos for knowing the contract terms. Mine states 30 days, usually couples have digital files in 2 to 3 weeks. You've been patient, I'd call and get answers and remind her of the terms in a pleasant but direct way. This lets her know you mean business but aren't being evil about it....hold her feet to the fire in a non emotional and civil way.

    Mine stated minimum 3 week... they were ready in exactly 1 week from the wedding
