incorrectly filled out marriage license

I was recently looking over my marriage license and discovered that the person that married us did not feel in the year of marriage is that a problem?

    Talk to the county recorders office. You may have to have an amendment done. In my county amendments cost 11.00 but they are your first point of contact

    I am trying to get this figured out because unfortunately I am getting a divorce and I'm trying to find out if a divorce is necessary or what I need to do to go about making sure everything is legal

    You still need to find out from the county recorders office that your marriage license was filed with. They will have the answers you seek about whether this is an issue or not. I assume that with a divorce it would go by your marriage certificate that occurs once your license is turned in and filed and recorded with the county and not just your license that has an expiration date on it if it goes unused before a certain date. Make sure everything was filed with the recorders office first regarding the start of the marriage before starting the or continuing on with the dissolution of the marriage. Sorry to hear that you are on this path.

    Is it the actual license or a certificate? When you get married the minister/officiant fills out license and turns that in but gives you a certificate. If it's just the certificate then it shouldn't matter.

    Not sure about your state, but in mine, when you file for divorce, you have to include a copy of the marriage license. Talk to the clerk's office and get it straightened out first. Is there a date anywhere on there? I'm pretty sure mine has both the date of the wedding and the date that the county recorded it.

    I know in FL it has to be completed within sixty days of filling for the license. It might have gone through because they can look at the date issued and can figure out the year.

    If you have a filed marriage license you have a legal marriage. If you don't have a copy of your license, then request one from your county clerk's office. I would guess that if there had been a problem with the license when it was sent in for recording you would have known about it then. Definitely talk to an attorney regardless.

    I'm totally confused by this, honestly, and I've been confused by the best.

    For starters, don't listen to legal advice (and this is in that arena) from anyone here. Every single state is different and there is no blanket statement that anyone can say with authority, even me (not being arrogant, but I see over 100 licenses every year....). In NJ, we go by the city; every marriage has two cities involved and four copies of the license filled out, so you can just imagine the possibilities.

    Are you talking about the 'real' license that you got when you were married the first time? Because I can't imagine that the clerk processing it would even issue your actual license without a year on it. Pretty much every mistake on a license is a big deal, and the further away from the date of the marriage, unfortunately, the more complicated and time consuming correcting them can be.

    In NJ, once I pronounce you married, you are. I am legally obligated to file the license or I'm liable for a penalty and fine. If there is any issue with the license, the officiant would have heard by now.

    Did you request a 'real' copy of your license? Or are you going by the receipt copy that your officiant gave you on the day? My receipt copies are rarely entirely filled out because I prefer to do that in my office, when I can really focus on them. So if that is what you're looking at, it is totally possible that your officiant finished it off before they submitted it.

    Contact the clerk of record where you got your license. In any case, I believe you're going to need a copy of your divorce decree to get a marriage license and you need a copy of your marriage license to get a divorce.
