Impossibility agreement language

Augustbride19, on August 6, 2018 at 10:39 AM Posted in Wedding Reception 0 7
Can someone explain to me what this means in simple language. I am getting confused reading it. Thanks

Impossibility Clause: The performance of this Agreement is subject to termination without liability upon the occurrence of any circumstance beyond the control of either party – such as acts of God, war, acts of terrorism, government regulations, disaster, strikes, civil disorder, or curtailment of transportation facilities – to the extent that such circumstance makes it illegal or impossible for the venue to provide, or for groups in general to use, the venue facilities. The ability to terminate this Agreement without liability pursuant to this paragraph is conditioned upon delivery of written notice to the other party setting forth the basis for such termination as soon as reasonably practical - but in no event longer than ten (10) days - after learning of such basis.

I think it basically means, if an act of God happens (hurricane, tornado, etc.) and the venue can't host your wedding, the contract can be terminated without them having to find you another venue or have any liability. And they have up to 10 days after the event to let you know this has happened.

I'm really not sure. I'd call the venue and have them clarify!

There should be another clause in the contract about non performance and return of the deposit. What does it say?

Nope. Nothing in that sort. It only talks about cancellation from our side.

There is wedding insurance that will cover cancellation in this sort of circumstance.
