I'm so dumb, didn't sign a contract with caterer. Gave a small deposit, now need to cancel.

Hi, everyone, I've been a lurker until now, I need help please. The advice here is great even if I get some tough love today I will appreciate it. FH and I were originally planning a park reception. Hi, everyone, I've been a lurker until now, I need help please. The advice here is great even if I get some tough love today I will appreciate it. FH and I were originally planning a park reception. I found a taco caterer who was in our budget and has about 100 great reviews on yelp and other sites. I texted the contact on their website and they stated they needed only $50 to hold the date, June 1st, 2019 (100 guests- about $1000 total). I agreed and sent them $50. Looking back, I've been so diligent during planning to cross my T's and dot my i's, and here I blew it.

Well, FH and I are completely changing our plans and can no longer use them, if we go through and sign with our dream venue. I figured I would text them to cancel and obviously not expect the $50 to be returned, fine with me. I'm just really worried they will say it's a legal contract and I can't cancel or I still have to pay. They never brought up their cancellation policy, it's not on their website either, and I never asked.

I may be worrying about nothing, but I would like advice on what to say if they refuse to cancel the texted contract. I will text them in the morning.

Thanks everyone for your replies. I got in contact with the caterer and he was a doll . The cancellation is fine and if in the future I would like their business I can use the $50 towards that.

Oh, he didn’t give your deposit back? $50 isn’t that big of a deal. Glad things worked out.

No they didn’t . But I’m totally fine with that. He did say I could use it as a credit for future catering though. Thanks.
