Getting Married in Different State Than Where I Live Question

D, on December 3, 2010 at 7:14 PM

I noticed a lot of people are getting married in a different state than where they live. Do you have to get married in the same state where you get your marriage license? I live in FL and want to have the ceremony in CA. Do I need a CA marriage license? Any help is greatly appreciated. Thanks.

I live in Texas, but me and my fiance are going on vacation to Denver Colorado and want to get married up there as well, so we were wondering if it legal in the state of Texas.

We live in TN, but plan on getting married in New Orleans. I called my local county clerk and was told we can use our TN marriage license anywhere as long as the license is postmarked within 3 days of the ceremony and sent to TN. However on the marriage license itself where the officiant fills out their part, it says in the state of TN and asks for the County that the ceremony took place. I also read on TNcounty.com that a TN license may be used anywhere, but why would the license indicate otherwise???

Hi everyone! You should always call the county where you are getting married for accurate information on the marriage application process.

In the US - marriage licenses from every state are recognized in every other state, but every state has different licensing and application requirements. So @Christie - that means that if you get married in TN and have a valid TN marriage license, it is recognized as a valid marriage everywhere else. You'll need to get a marriage license from the county where you are getting married in New Orleans!

So to start - google the county clerk for the county where you are getting married. Ask them for the full details on the marriage license. Pay close attention to the following things:

    - Is there a waiting period?

    - How long is the application valid for?

    - What forms of identification do you need?

    - What forms of payment do you accept? (my county clerk was check or cash only!)

    - Is my officiant legal and recognized by this specific county?

You will take your finished marriage application with you to your wedding, where your officiant will finish filling it out and get signatures from witnesses as needed. Your officiant will mail the application in and you will receive your marriage license at a later date. You'll have to check with the county clerk's office to see how many days it will take, and whether they will mail you the marriage license or if you will have to pick it up in person!

@cindy - you have to ask the county clerk in the county where you are getting married. They will be able to provide you information on legal and valid ordination services.

@Tony - No. If you are married in one state you are married in all US states. Your fiance needs to secure a legal divorce, then she can get married again in a different (or the same) state.

@Alicia - I hope you got a marriage license from Colbert County, Alabama!

@Sav - If you and your fiance get legally married in Colorado, your marriage will still be legal in Texas!

@David - If you guys get married in Vegas, you're married! You will still need to make any insurance and benefit adjustments on your own, but you are legally married and viewed as a married couple for all purposes.

@Brenda - that is correct! You'll need to apply for your marriage license in Belmont County, Ohio. We live in DC and got married in Moore County, NC and went down a few days early to apply for a marriage license!

@Charlotte - You'll need to look up the marriage application information for the county where you are getting married in Florida!

@Kat - You'll need to look up the marriage application information for Las Vegas!

@Kathleen - You'll need to look up the marriage application information for the county in Indiana where you are getting married!

@Christie - You'll need to look up the marriage application information for New Orleans and get your license there!

My husband and I did a Quaker Self-Uniting ceremony through Pennsylvania over a year ago, but now we are having an official wedding in Maryland. Should we apply for another marriage license in Maryland in the county where we are getting married?
