Drunk Drivers at Wedding

Marcella, on October 21, 2019 at 3:34 PM Posted in Wedding Reception 0 9
Could I be held liable for drunk drivers leaving my wedding? The hotel we booked rooms at is about a half hour drive away, but my father in law made a comment stating that we could be sued if someone drives drunk and gets into an accident/causes damage after leaving the venue. Does anybody have details on this?

This actually varies by state so I would look up hosting laws for where you’re having the wedding.

Whoever serves the alcohol could be held liable. As long as you have a licensed and insured bartender, you shouldn't have any issues.

We had a licensed bartender & wedding insurance, both would be liable if someone got a DUI but not us. We provided transportation to avoid this all together.

Not too sure, but are you supplying the alcohol or is it a hired service (ie through catering)? If it's catering I would imagine they are held liable and have the appropriate insurances.

This has actually never crossed my mind. When attending weddings I know that I will be drinking throughout the night and will ensure I take an Uber to the event.

It depends on your state law. However, in at least many states, hiring a licensed bartender immunizes you from liability.

Could you offer a shuttle option to the hotel at the end of the night as a precaution?

I mean I would feel less worried about the legal ramifications and more worried about the safety of my loved ones and anyone else out there who could be hurt or killed? Are they really that irresponsible? Definitely give your bartender a cutoff, but understand that number is different for everyone. My mom can house 3 vodkas and be fine, but give me half a glass of wine and I'm going to be wasted.

Check your contracts. I believe my venue’s contract put some of that liability on the couple/family hosting and required we secure insurance. The bartenders were included as part of the venue’s wedding package and that didn’t absolve us.

We are only having alcohol served for 5 hours, we bought the alcohol, so we know how much will be consumed, and our wedding will be 7-8 hours long. We did that purposely so that people weren’t drinking right before they left the wedding. This way there is a bigger chance of drunk drivers.
We are also giving people Uber discounts if needed.
