dj not giving deposit back

I hope I don't sound insensitive or bratty in this post. But we chose our DJ, put down our "nonrefundable" $300 deposit. He sadly passed away and the wife is now in charge of the business aspect, while his friend (or sub contractor) is helping and taking over all the events. We waited to make any decisions because we know they're grieving. We did want to meet with him though, set up a time. The day came and he kept pushing the time back, so he was going to be late and we were already at the place and would have to wait another half hour. Last thing I want is someone to not be punctual on our wedding day... we called the wife and she said the deposit is non-refundable, but I feel like these are unusual circumstances and there should he ask exception... is anyone familiar with the laws about this?

    Oh, what a sad situation. Does your contract specify that you hired one DJ in particular, or does it say that you hired his company, that his friend also owns/works for?

    If the original DJ cannot perform for you, then the contract should be automatically voided. You did not sign the contract for the service provided by his wife or his buddies. You shouldn’t be forced to work with them if you don’t want to. It’s so strange that the wife refused to give back your deposit

    You should definitely get your money back. The DJ you hired is unable to be there and understandably you don't want to force the widow to give you money back but the contract was signed with the late husband.

    As someone who is in the wedding industry, I actually have a clause in my contract that if something were to happen to me, then a replacement will be offered and therefore it is not voiding the contract. If the couple were to cancel, they are not responsible for the final payment but would not get back the deposit. So technically, if they have this clause, they can hold onto the deposit. But I would definitely read your contract to see if they have something like that!
