Did we get screwed? Venue contract vs Covid

Ashley, on June 16, 2020 at 1:59 PM Posted in Community Conversations 0 15
Hey y’all. I’m feeling a whole lot of anxiety right now. Our wedding is set to happen 10/2/20. We are in AZ, and are seeing a huge increase in cases with talks of another lockdown. With less than 4 months until the wedding, we reached out to our venue to talk about postponement options. Their reply was simply “we are not discussing postponements at this time.” While
I understand their concern, how long do we need to wait to make this decision?? We talked about the possibility of just cancelling and having a small wedding in our parents backyard, but after reading our contract, there’s no way out of it. We signed our contract last June (15 months in advance) and paid it off in January, so wayyyyy before this all started.

Continued- after reading the contract we realized that we would lose ALL the money we paid because we would have had to cancel the wedding within 9 months of the original date. 9 months?!? Ugh. I’m just feeling so defeated and upset that this is happening and the venue is so non communicative. Any thoughts or feedback would be so helpful.

There's absolutely nothing in the contract that talks about postponements?

Is there an “act of God” policy? My venue is using that for their covid policy. If we have to reschedule it just has to go around their other events but we won’t lose any money and for our knowledge it won’t cost us anymore.

$500 for a postponement seems pretty minor versus losing all your money.

If you're listening to the news and following everything, I find it hard pressed to see that the world will shut down again. The economic impact alone will be repairable

Yeah absolutely, I guess I failed to mention that our date is so significant to us, and after talking to other couples that signed to our venue too, they are not allowing them to postpone more than 4 months out which is my worry too. With our case in AZ, we’re a national hotspot which is my worry at the moment ):

They do have a similar policy, but they won’t let us even postpone it right now which seems ridiculous. It’s less than 4 months and we haven’t heard anything from our coordinator. I mean our families keep asking and we can’t even provide any answers which is where my frustration lies

You could always get a lawyer depending on how much money. or threaten them to get a lawyer but it would depend on the circumstance. if the wedding is legally allowed to happen then technically its your “fault”’for cancelling. if you have to cancel because they wont allow u to have the wedding then youre entitled to your money back

Our wedding is planned for the Keys and FL too is getting "hot" again. I have faith it will all work out.

Wow, I had no problem with my venue postponing. I think $500 for postponement is a BIG deal. I agree with Queen Cone, try and work things out with them in a month or so but if they are still unwilling to work with you. At least talk to a lawyer.

I wouldn’t guess they’re hoping it turns around. But until it starts again (how horrible) with lockdown, they’re needing to move forward.

Having just lived through being a hot spot, *if* AZ acts, by October, you'd likely be able to have some kind of thing. That said, they'd have to act now to get things under control in time.

But, my parents live in AZ, so I understand your worry, as it is... well, there's not a lot of action. Since you're October, I'd try to hold off at least another month before going back to the venue. If they aren't talking about October now, they probably just don't have any idea of what they're going to do.

Maybe research backup plans, and have a chat with a lawyer, but keep those in your back pocket until you need them.

I'm totally not in the same situation, but our venue wouldn't let us talk postponement until 2 months before our July wedding. They finally did let us pick a new date with no added charges, which was amazing. I know how you feel though - waiting until 2 months before was absolute hell - I was feeling somewhat confident at 4 months out that things would calm down, but increasingly anxious by 3 months. My guess is that the venue sees your date as very far out with a lot of chance of improvement.

Can you ask your venue at what point they WILL be discussing postponements?

I’m in AZ too and getting married 10/10/20. My vendors have said no postponements or cancellations unless Ducey declares another state of emergency. I’m really hoping the mandated mask rules help to curb the numbers from continuing to climb!
