Destination Wedding + Marriage License Stuff

Tina, on February 10, 2021 at 9:14 PM Posted in Wedding Ceremony 0 10

Hello again!

My fiance and I were going back and forth over this so I wanted to get some input. I want our ACTUAL legal wedding date to be the getting married in Mexico. I keep reading that you should get a civil service done in the US first (which would make our legal date different) and originally I had thought to do that, but now I'm wondering.. we live in NC, once we get our marriage license, it is valid for 60 days. His dad will be our officiant in Mexico. Can we not like, mail it in once we get home? This way we technically keep our ceremony in Mexico "symbolic" (as opposed to jumping thru hoops to get 2 countries to recognize it). I don't know if I'm missing something important or what.. but isn't that how people do it if they get married in another state anyway?

Thanks in advance for your help!

No your license is only valid for a certain time frame in the state it was issued. You cannot backdate anything because it will be deemed invalid. Talk to the marriage license office in your state and follow their laws to the letter.

There’s a few things here 1) No, you can’t forge legal documents. Like ever. 2) I may be misunderstanding your comment, but a North Carolina marriage license isn’t valid in Mexico. You need to get your marriage license/permit from whatever jurisdiction you are getting married in. 3) If his dad does marry you in NC, make sure to research the laws there as online ordained officiants are not recognized there (not sure if this applies to your situation).

Ok, this makes sense. I think what confused me is people get their license here cause they live here and then get married in another state within the 60 days without an issue, so I wasn't sure if the location of the ceremony mattered, but I suppose there is interstate recognition or they took care of stuff behind the scenes.

His father is an ordained pastor so there is no issue in that regard, and we did look up if there were any extra requirements for our state (there aren't).

If they are getting married out of state, they should be getting their marriage license from the place they are getting married in. Regardless of what state you live in, you are always supposed to get your marriage license from the state/county the wedding is taking place.

Haha no worries! That's why this forum is here! But yeah, when it comes to the legal stuff, everything should be done in the state the wedding is happening. Otherwise, you run the risk of the marriage not being valid.

The marriage license office in your county will tell you what the laws are.

Your license has to be from wherever you're getting married. For example, I live in VA but am getting married in NC, so we have to get an NC marriage license.
