Destination wedding license and residency in another state

crystal, on May 4, 2015 at 2:58 PM Posted in Planning 0 5

We are getting married in Florida and we live in Texas. We plan on getting our marriage license in Florida. but we want Texas law to control- what would we have to do to ensure Florida law would not control short of a post-nuptual agreement? would registering the marriage license in Texas be enough? is that what couples do when they get home is just register a destination wedding certificate in their home state?

You should contact a lawyer if you're worried about state law affects marital assests.

You need a lawyer, seriously. You don't have to register in your home state; your license and marriage is valid in all 50 states (assuming you're not a gay couple).

Thanks for the feedback. we are a hetero couple and I know the marriage is valid everywhere. I am just wondering- do couples who get married in destination weddings come home and file their marriage certificate at home or just leave it in the locale they exchanged vows? I have a general understanding of family law but there are no forums discussing what to do with your out of state- or possibly foreign- marriage certificate after the fact.

I officiate FL weddings for couples from all over the country and all over the world.

Your marriage will be recognized without registering anywhere but FL.

You can take your FL marriage certificate home with you or it can be mailed to your home address.

If you have concerns beyond that, speak with a lawyer.

The officiant will file your marriage certificate for you.

Every state has different laws. In California, you can get a public marriage license (not a confidential license) in any California county, and use it in another California county. The officiant has to return it to the county that issued it to the couple originally.

Yes - other states will recognize your marriage certificate as legal, except for same sex marriages (unfortunately).
