David's bridal contract?! So frustrated

Okay, I ordered my dress from David's Bridal (In Madison, WI) this past Sunday, the 18th. I did the SOR layaway so I have 60 days to pay the dress after I put 25% down on Sunday. I'm realizing that I'm not able to pay for it all in 60 days so I reviewed the contract that they gave me. It says

"Forfeiture fee: I understand that upon termination of the SOR layaway contract due to nonpayment or cancellation (after 10 calendar days from the SOR creation date, excluding Sundays and mail holidays), a forfeiture/cancellation fee equal to 10% of the value of the merchandise will be deducted from the deposit and the payments made on my SOR layaway purchase, unless state law requires otherwise. The remaining balance will be issued in a store merchandise credit, unless state law requires otherwise. The layaway brochure I received contains a list of the State Exceptions to this policy."

So my understanding after reading this is that after 10 days, if I cancel my order, I will be (cont.)

    (cont.) charged a 10% forfeiture fee. But if I cancel within 10 days from my order date, which was 3 days ago, that forfeiture fee will not apply. I called the store and they are telling me that this is not true, no matter how long it's been I will be charged a 10% fee. Am I reading/understanding this contract wrong or what?? The lady that I talked to on the phone was very rude and would not give me a straight answer. She said "well we'll just say that yes, the 10% fee will apply. She wouldn't put me on with a manager and was extremely rude. I'm in tears over here and don't know what to do. Please tell me if I'm understanding the contract right or if the store is right and if any of you have had experience with this....

    It sounds to me like you should be okay to cancel because you are in within 10 days, however it is not clear to me whether you will get a full refund or your deposit thus far would be issued in the form of store credit.

    Did you call the consumer line for the customer service department? You should have much more luck than dealing with a store clerk. If for no other reason, because those conversations are typically taped.

    I think it would be best to walk in with your contract, and the part about the 10 days. Be prepared to receive store credit for the down payment though, even if they don't take 10%.

    I canceled my layaway order about 15 days after and yes I lost the 10%but gave the rest of my payments back. And I agree, once they hear you say you no longer want your dress from them, they treat you nasty. I experienced this, they somewhat nicer up once I told them my bp will be getting their dresses from them.

    They have that contact, but every store is different, honestly. I've dealt with 3 different DB stores during my planning.

    Yes, normally they will charge you the 10% of the total price of the gown, subtract that from your deposit & issue you the remaining. However, when I canceled my layaway, I was able to choose whether or not I wanted store credit or for them to put the money back on my credit/debit card.

    The one time I was a few days away from paying, I talked directly the the manager who was incredibly sweet. She extended my due date without any hassles, and was really understanding that I was just waiting for more funds.

    Call corporate or call the store again. When they answer, ask directly for a manager before even telling them why you're calling. I've been dealing with crazy stores, then some amazing ones too. I was able to extend my date & still get my dress. It just took a while to find someone who was willing to work with me.

    Allyson, I called that number but it just made me choose the store and directed me there. I honestly don't want to talk to them again right now. They also told me that to cancel I had to be in the store. Which makes sense but it's two and a half hours away. But I didn't even get into that on the phone. And I do think that it goes to store credit but that's better than it just being taken away from me. I'm just so frustrated right now. I've read so many things on weddingwire about david's bridal and bad experiences. I had GREAT experience when I tried on the dress and my consultant was great, I loved her. But now everything's going downhill and I'm so stressed out.
