Covid Wedding

So due to the pandemic we wanted to change our wedding date for some time next year.

We decided to hold off on making any plans because we were so sure we were going to postpone. Also we avoided talking to the owner of the ballroom to respect her privacy due to her losing her partner to covid.
So we decided to find out if the they could change our date 3 weeks before our original date and they told us they couldnt change it unless we paid 1,500 more. We could have done that but we wanted a new contract where they could assure us if for some reason they couldnt hold our event that they could give our money back or at least part of it and they said no. So in other words if we paid 1,500 to change our date and for some reason they couldnt make our event we would lose over 10,000. We are somewhat losing some money because now our event is with limited people and we already paid everything for more people. There is no way they are giving us our money back and now we are going crazy and stressing planning everything last minute. What would you guys do? Can we sue them for the extra money that we are paying?

    Did you contract mention anything along the lines of "in an event out of control" or "act by God..." It may be much harder to sue if it made any of those mentions.

    I would read your contract thoroughly and look for key words that would indicate they indeed can’t just keep your money. If you signed pre-pandemic you’ll likely see “act of God” you are not liable.

    Refer to your contract for specific verbiage. If your area can still do events, even if limited, you’re probably stuck.

    No none of that. In the contract it does state that we would have to pay 1,500 extra to change the date of our event but the thing is that she just opened her venue and since our event is on a day her venue is open that is the only reason she is charging us. If it was for her venue still being closed down she would change the date with no charge. She told us this a little too late and there was no notice of anything if she would open her venue or not. We had to find out for ourselfes.

    Contract just states fees are non refundable, but there is nothing on the contract that states "act of god". I would like to see if i could get the extra money i paid refunded because we paid for amount of 300 ppl and now were only having 200 ppl because its limited.

    Venue is already opened but its limited to 200 people and we already paid for the amount of 300 people. So thats 100 less plates of food, tables and chairs, drinks, smaller cake. Its already paid for and im not getting the full package.

    You can technically sue anyone for anything you want but you’ll likely spend way more time and effort on lawyers and fees than what you lost

    Our venue tried to do something similar to us. We called in March for our December wedding and were told that everything would be fine, that if things were not back to "normal" we would not be forced to hold our wedding and that we could move our wedding without penalty. Fast forward to June, we were told that in order to move our wedding date, we would be paying increased 2021 prices and a 5,000 rebooking fee. Look over your contract very carefully and consider all options to get exactly what you need. I wouldn't pay another dime. This pandemic is out of your control. We moved our wedding to December 2021 without any extra fees. The squeaky wheel gets the grease!
