Covid refunds for wedding April 11 (postponed/cancelled)

Jeff, on May 20, 2020 at 2:31 AM Posted in Community Conversations 1 3
Hey everyone!
- What arguments are best for a refund due to covid?
- Any opinions appreciated

We were going to have our wedding reception on April 11. Mid March (12-15th) we talked to our venues and most suggested to postpone and change the dates due to the start of covid. Although we didn't have another date in mind our venue said we can move it back upto a year. We agreed to "an unknown date" because they all said "it's Non Refundable at all" but since the quarantine/lockdown and everything happened some friends and family said this may have change some things to get our refunds because of the "Act of God" clause (natural disasters etc void the contracts)
We were planning on moving out of state next year and don't want to put our whole lives on hault just for the wedding reception (we did a civil wedding) and after losing jobs (temporarily) because of covid every dollar saved helps. What do you think is our best bet at the moment? What would you do and what are the best arguments to bring up? Please let us know, we appreciate any feedback!Hope you all stay safe during these times.

Is there an "Act of God" Clause in your contract? I went through this with my Day of Coordinator and once I started quoting her contract she quickly refunded my deposit. Have you signed anything further stating a new date? You can also start with sending them a certified letter stating all of the above. It lets them know you are serious and are documenting the interactions in the chance you may seek legal action, which they definitely dont want.

Definitely look at the Cancellation and Act of God policies in your contract. There aren't really any "good arguments" except quoting the contract directly. If it isn't in your contract, you don't have solid ground to stand on. Use the contract and quote directly out of it in written communication and most vendors will follow the policies from the contract immediately.

The problem is for our photographer it does state the act of God clause. But for the Emcee/DJ it just says non refundable. And stuff like fully responsible to pay for everything even if cancelled. But a friend of ours told us just because a contract states certain things doesn't fully make it right/valid and it can become void. Just trying to see some people's opinions who may have had a similar issue work out
