Coronavirus Postponement: Contract Terms - Unfair Pricing

Hi everyone! We were supposed to have our wedding on May 2nd at Waterloo Village in New Jersey. Due to a ban in NJ on large gatherings, our venue forced us to pick a new date for the wedding. They offered us any date from July 2020 - March 2021. We do not want to have a winter wedding and there were no Saturdays available through the summer, so we chose a Friday in July. When they sent us the contract addendum to sign for the new date, it is stating that all terms and pricing remain the same (meaning - we have to pay Saturday pricing for a Friday wedding, when it's usually cheaper on a Friday). Has anyone else run into this issue? How are venues handling your postponement? We are now fighting with our venue and they refuse to give us the Friday pricing. Their response is "that's not how we run our business." Not really sure what our legal rights are, and I couldn't seem to find anything in our contract regarding THEM canceling on US and how that works with the deposit we've given.

    I️ would have your lawyer or even someone who has those skills look over the contract. Sounds like they are trying to make money off of you. Then again if there are other Saturdays in different months and you’re not willing to choose them I️ could see why they aren’t budging with price.

    The next Saturday that they have available is December 19th. They were trying to get us to choose a Saturday in December but the December Saturday pricing is EVEN CHEAPER than the Friday pricing in July! We are having two of our friends who are attorneys take a look at our contract to get feedback.

    I do not know/completely understand the legality of it but if we have to postpone our Saturday wedding to a Friday (or Sunday), our venue said they would not refund the difference. They pointed out a certain idemnify clause in our contract that mentioned uncontrollable circumstances.

    Look for provisions like “force majeure” “act of god” in your contract or impossibility. Some contracts are written such that deposits are refunded but I had a few vendors who wrote it such that they got full payment even if we couldn’t hold the wedding (My fault for not reading close enough bc that’s bs). But I’d try to cancel outright get your deposits back and then enter into a new contract for the Friday pricing if you can. Or if you have insurance cancel and try to a claim for the lost deposits.

    We didn’t even try to change our pricing from Saturday to Friday pricing with the venue or anyone else...we just rolled everything over from May 9 to August 14. Honestly, these venues and vendors are really taking a huge hit, and are losing months of income because of this, so it’s just not something we wanted to fight about. Our venue is family owned and operated, and I know it’s all just as stressful on them as it is us. I am just relieved that we were able to find a new date that works for us and the venue. I’m not saying this is what you should do, but I would weigh things like this out before letting it develop into an ugly fight.
