Contract doesn’t say non refundable deposit

Hello! We were supposed to get married June 13 and decided to cancel our big celebration due to covid and have a tiny celebration because a lot of our guests are out of state and it’s challenging financially during this time. I texted the venue owner asking for a refund of our deposit. He told us it is a security deposit that will be returned if after the wedding, the venue is returned to its original state and there are no damages. No where in the contract does it say that the deposit is non refundable. He replied saying it’s non refundable and we can pick a different date if we want. We have decided not to pick a different date. Is that allowed, that even though the contract does not state anything of the deposit being non refundable, he is saying it is nonrefundable? What should we do?

    I’m really sorry to hear you’re dealing with this that doesn’t seem right. All of my contracts have printing stating if the deposit Is refundable or not. I hope everything works out for you in the end I’m so sorry this is happening

    Hi Alina! I'm a little confused. Is the deposit non-refundable? Or is it a security deposit that is held against damages? If it's a security deposit that would be fully returned provided there are no damages to the facility, then you should definitely get that money back. However if the deposit was non-refundable then you will be forgoing those funds.

    I'd review your contract - specifically what the deposit is for and the cancellation terms!

    Hi! The contract doesn’t say that it is non refundable and we were never told that it is non refundable. (Until I texted him asking for it back and he said he can’t because it’s non refundable) we were told we were paying a security deposit for any possible damages but we obviously haven’t used the venue yet so we haven’t made any damages. We were told if we don’t make damages then we will get the security deposit back.

    Hmm... so weird they won't just refund you that security deposit then! It sounds bizarre - can you "go through with the event" and just have no one attend and then get the deposit back?? 🤷

    No because we can’t have our wedding then and there. We would have to pay the full price of the wedding. That just wouldn’t make sense to do that just to get the deposit back
