Our venue has filed for this. What does this mean?

    The email made it sound like they will be conducting business as usual.

    we have paid 4250 and will be paying 1725 in October and then in April. Is there any risk?

    I'd say there's always a risk for something in that situation but if they are filing chapter 11 then the business is still up and running. I would probably inquire about what it would look like if they were to shut down within the time frame before your wedding (refund, providing back up, ect). Smiley smile

    Chapter 11 I’m pretty sure is a nice way to say bankruptcy...

    Given your wedding is so far away, I would be concerned (though I hope this wouldn’t happen to you) that the venue would shut down prior to your date. I don’t know the legalities of this but I personally wouldn’t be giving this venue anymore money...

    Chapter 11 is basically a supervised restructuring of how a company pays its debts. While it is technically a bankruptcy, the company remains in business but is monitored by the bankruptcy court until the plan for repayments has been completed.

    I'm a bankruptcy specialist. Im mostly familiar with ch 7 and 13 but from what I understand ch 11 cases are difficult and the success rate is very low. This would make me a little nervous. If their case gets dismissed I wonder how they would be able to refund your money.

    If you don't have cancellation insurance I would look into it, although I'm not sure if it would cover it since they are already in bankruptcy, but I would definitely talk to an agent. If you have an agent for your homeowner's insurance or renter's insurance they should be able to help you find event insurance /cancellation insurance so you can get your deposit back if they go under. I got mine through Traveler's. Just explain your whole situation and see if they can help.

    I got insurance last week because it was on the news that they hadn’t paid their taxes and there was a lawsuit. We got an email yesterday saying that the lawsuit was settled but they filled for chapter 11 reorganization. But that they are still running things as usual. Not sure what to do now.
