Canceling Caterer... Experience?

Hey Ladies! My Fiance and I have had to make a change to our venue and thus our caterer. This is 100% my mistake and I am hoping this isn't a 1400$ lesson. I have reviewed all my contracts and emails and notes and NOTHING notes the cancellation policy. My photographer and venue all do and since we are still 8 month away from the wedding, I am definitely getting those deposits back in full.

Does anyone have any experience with this? I am going to call them this week and also put the details in email but I want to try to get as much, if not all of my money back. I am just not sure how likely that will be because NOTHING notes a cancellation policy.

    My first thought is that them having no cancellation policy might work in your favor.

    From everything I heard and read, if it's not in writing in your signed contract, it doesn't exist. I'm not too positive on the legalities but it sounds like it'll work in your favor if it wasn't covered in the contract.

    Deposits are almost never refundable. Does the contract mention the deposit?

    I'd think if there's nothing stated in writing about cancelling, you shouldn't be out anything but the deposit. I'm not a caterer but I don't think they'd have anything for your wedding this far out anyway except probably contracts with their suppliers (which if they have cancellation policies I'd think the caterer may try to trickle that down to you or maybe that's what the deposit is for).

    Yea if they didn't note the cancellation policy or anywhere at any point in your communication state the deposit is non-refundable you should be okay.

    My deposit for the venue and photographer are 100% refundable as long as it is within a certain time frame and since I am still 8 months out, I will get the deposits back in full for those. In regards to a mention of the deposit on the catering contract, it simply states what the deposit is and when the remaining is due. Nothing else.

    It is hard to believe that a Caterer would have a contract without a cancellation policy, that is odd. Most clearly state it and most refunds are dependent on the time frame. As in 120 days or more prior, fully refundable, 90-120 days 50% refundable, 60-90 25% refundable and then 0-60 days, you lose all monies paid. That is how my contract works. I would call them and speak to them directly for clarification. Hope for the best but be prepared for the worst. If it is not in writing that there is a cancellation policy, then that is absolutely in your favor.
