Can you get sued for serving alcohol ??

So we want an open bar but my mother is freaking out worried if someone leave while intoxicated and gets into an accident that they could sue us. Is that true ?? We are thinking of hiring Big Day Bartender for the wedding because I don’t want a dry wedding the bartenders are TAM certified and carry both general and liability insurance.

    Yes and no.

    Whoever is serving alcohol is liable. If you are hiring a licensed bartender then they are liable for not over serving your guests.

    I’m not a lawyer but I would think that would fall under the insurance of the bar tending service because they are the ones serving the drinks. That’s why you would hire professionals. I would check with them by reviewing their contract and asking what incidents their insurance would cover. I would think its like a caterer that would be responsible and insured to cover any incidents that could happen through their food.

    Depends on the state I suppose. I know in TN if someone goes out and gets intoxicated at a bar and kills someone, the family
    can sue the restaurant, the bartender/server, the manager. I think that’s the dramshop law.

    It does depend on the social host laws in your particular state, but possibly yes. If you provide the alcohol with no liability then sure. This is what hiring bartenders protects against. With bartenders, you generally also buy into liquor liability insurance. These people then presume the responsibility, and you are protected

    Definitely look into your state laws and ask your bartenders to carry the appropriate insurances. In the state of Maryland, those serving can be sued for over serving. Also ask if they provide an incentive for designated drivers. At a friend's wedding they gave free soda and coffee to those driving.

    It would be no different than me going out for my company's holiday party at a bar. The bartender would be liable, not my boss.

    Yes this is true, I would also add to make sure they have insurance and can provide to you before signing a contract.

    Just get wedding insurance through Wedsafe. It's around $175 and covers in case you are sued. Potentially, a person can sue the couple or venue or bartenders if they over serve and someone gets hurt.
