Alice in Wonderland. Curiousier and Curiosier...

MariainAZ, on December 9, 2009 at 6:01 PM Posted in Planning 0 2

On that venue that has articles in the newspaper that they are going Chapter 13 or looking for a buyer. I sent an email stating that I would consider their venue IF in the contract I was a "secured creditor" (meaning in the event of a Chapter 13, I am one of the first in line to get my money back--ALL of it) or that I would be entitled to a full refund of all monies including the so called "Non-Refundable" deposit. I have yet to hear back. It seems like they are protecting their interest while leaving mine high and dry. DOne venting

I would be VERY careful doing that. If they do go bankrupt, there's no guarantee the judge would give you anything even if you do have a contract stating that you're a "secured creditor". And even if the judge did rule that, you would simply go on the payment list like everyone else, so it could take years for you to get all your money back. Please reconsider, or at least seek professional legal advice before you sign anything or give them any money.
