The reality that many marriages end in divorce hit me like a ton of bricks when I finally found my person… despite practicing family law as an attorney where divorce is literally part of my job. I can tell you with so much certainty that my future husband and I will never get divorced. This is my first (and I plan on only) marriage after being cautious due to a tumultuous childhood, characterized by domestic violence and child abuse. But my “legal” brain had a serious conversation with my “lover” brain and reminded me that we simply cannot predict the future.

Approximately 10 months before the wedding date, my future husband and I drafted and signed a Prenup. Reflecting on the discussions leading to the Prenup, I feel they were necessary for us to create a strong foundation that we can build upon during our marriage. And now, I can focus with much more comfort on our wedding plans! For as long as I can remember there has been a stigma that follows the word “Prenuptial Agreement” aka “Prenup.” Many may view the Prenup as a negative thing by asking the common question: “Why would I make plans for my marriage to fail before I even walk down the aisle?”

A shift in our societal perspective is needed. Through my personal view, a Prenuptial Agreement is like insurance - “in case something happens.” We don’t purchase a healthcare insurance policy with the mindset that we are going to become ill, but rather we have the insurance policy in the case we do become ill. We find solace in having insurance that provides a safety net for medical care and expenses. This same logic can be applied to Prenuptial Agreements. After spending the past several years in family law, I have witnessed firsthand how quickly things can go south when couple finds themselves at odds in their marriage. With having a Prenuptial Agreement in place, most of the hard conversations - especially with finances - have been discussed and agreed upon during a state of love…instead of mudslinging. Even if you do not sign a prenup, having these tough conversations with your future spouse prior to exchanging vows will only strengthen your relationship’s core foundation with communication and transparency.
