Changing Name Amongst Moving States Frustration

Autumn, on May 27, 2022 at 11:57 AM Posted in Married Life 0 4

Hi all! I recently got married in SC in January of this year. I put off changing my name because I knew we were moving soon after. We have temporarily moved to NC and will be permanently moving to FL within the next two months. I have tried researching name changes to find answers, but I'm so confused and lost. My list of problems/questions:

Do I have to go back to SC to get my name changed or does it not matter which state I am living in?

The marriage certificate does not have the new name I want to go by as there wasn't a place for it on the marriage license. Can I still use this to change my name?

I want to have an hyphenated last name. Can I do this without the new name on the certificate or will I need to petition the court?

To do a name change, am I essentially just letting Social Security office know what I want to go by? Do they allow hyphenated names?

Thanks a bunch for any advice!!

Hi Autumn! You do not need to go back to SC to change your name, you can do it from any state!! I got married in NC and changed my name in DC - and I also didn't have a marriage license that asks you to state your new name!

Social Security does allow hyphenated names, so I'd just get started with the Social Security office!

It entirely depends on the state. In Iowa the only chance you have to do it is on the marriage license and if you miss that chance you have to go through a long and expensive process. I would call the bureau of vital records in Florida and ask them how the situation is handled since your SC marriage license didn't have the option.

You do not have to go back to SC but definitely look up the laws in the state where you will be residing. Some states will honor a hyphenated last name and some will require you to petition with the court if you’re hyphenating.

Thanks all!!! You've definitely put my mind at ease over this. I'll look up the laws in FL and contact any necessary offices if I cannot find an answer online. Thank you so much for everyone's advice!
